Offline SMPS in metal case for consumer product?

Hi,
Please consider a 400W offline PSU in a metal case, for a consumer product, like in the attached video.

The following product has an inline , offline SMPS for the product shown.
(product is a consumer product for mass sale within EU/USA)
Its in a toally enclosing plastic case, with obviously no fans or air vents....

Do you believe it would still be conformant to all safety regulations, if it was in a metal case?

Its only 70W....but what about if it was 400W?

Also, Obviously the case would need to be earthed....do all EU plug sockets have an earth (eg the two pin ones)?
 

Please may i enquire.....which Safety Regulation says it can NOT be in a metal case?.....is it EN62368?
