Which design rule sets the minimum allowed distance between a drilled via/pad hole and an inner layer route or plane (the arrow in the picture)?

Via to Copper and Route to Via control this.

Also do not forget to add the drill oversize value if (as the pic suggests) you are using inner layer pad suppression.
