if i want 40000 sampling rates,
could i say
the baud rate = 960000 can satisfy 40000 sampling rates?

because usually is up to 24 bits that 40000 * 24=960000

This depends on the communication system. A commonly used system is one in which a frame consists of 1 start bit, 1 stop bit and 8 data bits. In this example, you would not have enought data bits. You would have to multiply the baud rate by 10/8 = 1.25. If you could supply more details about your system, I could probably come up with a better answer.

in fact, sampling rate base on what criteria can up to 40000 sampling rates?

baud rate? band width?
