If LPC2138 is 3.3V supported where as ATmega88 is 5V supported. Can we establish communication between them using I2C protocol.

If yes, then pull up should be tied to 5V or 3.3V? Is there any other special precaution should be considered in this case?

Thank you in advance.

Need to check VIH and VOH of both the IC's if it is in acceptable range you can. When considering about I2C you need to connect the pull-up resistor to supply of the slave device.
