I have been using ic5141 (5.10.41_USR4.54.77) with kernel 2.6 for a while and used it in one test chip and one production chip.
Everything works, and no LD_ASSUME_KERNEL required.
My current Linux distro is Gentoo; gcc ver 4.1.2; glibc 2.6.1; xorg 7.2; xfce4.4
